SEC Chairman: If Clarity Act is not adopted, the SEC will establish its own encryption rules

On 30 July, according to Decrypt, the Chairman of the SEC, Paul Atkins, Chairman of the United States Securities and Exchange Commission, stated that if Congress failed to adopt the Clarity Act, the SEC was "ready" to introduce its own code for encrypted money markets. Atkins stressed that legislation was the only way to prevent a change in the regulatory framework from taking place over time, and expressed optimism that the bill would eventually be passed. Currently, Clarity Act passed the Chamber of Deputies in July of last year with 294-134 votes and the Senate Banking Commission in May with 15-9 votes, but no full Senate vote has yet been held (60 votes). The majority leader of the Senate, Tunn, recently suggested that the bill might not be able to complete the vote before the August recess. If adopted, the bill would transfer the supervision of the spot market in most currency to the CFTC and remove it from the SEC jurisdiction. The SEC has been pre-positioned and the "ProjectCrypto\" regulatory programme promoted by Atkins has been placed on the 2026 agenda, which covers, inter alia, token registration exemptions, safe harbours and brokerage and is considered a transition programme for the Clarity Act。
